Terms & Conditions
Please read them carefully. By creating an account, entering a child, or casting a vote on our platform, you agree to be bound by these Terms in full. If you do not agree, please do not use the platform.
These Terms should be read alongside our Competition Rules and Privacy Policy, both of which form part of the agreement between you and Cutie Clash Pageant (Pty) Ltd.
1. About Us
Cutie Clash Pageant is owned and operated by Cutie Clash Pageant (Pty) Ltd (hereinafter referred to as “the Company”, “we”, “us”, or “our”), a company registered under the laws of the Republic of South Africa.
Our platform is accessible at cutieclashpageant.co.za (the “Website”) and provides a monthly online children’s photo and video competition service, including voting mechanics, games, and prize distribution.

2. Acceptance of Terms
By accessing or using the Website in any way, including browsing, registering an account, entering a child into the competition, voting, or playing games – you confirm that:
- You have read, understood, and agree to be bound by these Terms and Conditions in full;
- You are at least 18 years of age and have full legal capacity to enter into binding agreements;
- Where you are entering a child into the competition, you are that child’s parent or legal guardian and have the authority to do so;
- You agree to our Privacy Policy and Competition Rules, which are incorporated into these Terms by reference.
If you are acting on behalf of a company or other legal entity, you warrant that you have the authority to bind that entity to these Terms.
3. Eligibility
3.1 Use of this Website and participation in Cutie Clash Pageant competitions is open to South African residents only.
3.2 To register an account or vote, you must be 18 years of age or older.
3.3 Children entered into the competition must be between the ages of 0 and 12 years at the time of entry. The person entering the child must be their parent or legal guardian.
3.4 Employees of Cutie Clash Pageant (Pty) Ltd, their immediate family members (including live-in partners), and any person directly involved in the administration or promotion of the competition are not eligible to enter or vote. Any such entries or votes will be disqualified without notice or refund.
4. User Accounts
4.1 Registration. To enter a child or to vote, you must register a user account on the Website. You agree to provide accurate, complete, and current information at the time of registration and to keep this information up to date.
4.2 Account security. You are responsible for maintaining the confidentiality of your account login credentials. You accept full responsibility for all activity that occurs under your account. If you believe your account has been compromised, you must notify us immediately at hello@cutieclashpageant.co.za.
4.3 One account per person. Each individual may hold only one registered account. The creation of multiple accounts by a single person for the purpose of gaining additional votes or competition entries is strictly prohibited and will result in immediate disqualification and account termination.
4.4 Account termination. We reserve the right to suspend or permanently terminate any account at our sole discretion, without notice, where we reasonably believe that a breach of these Terms has occurred.
5. Competition Entry
5.1 Free entry. Entry into each monthly Cutie Clash Pageant competition is free of charge. No payment is required to submit a competition entry.
5.2 One entry per child. Each child may be entered once per competition month. Duplicate entries will be removed without notice.
5.3 Entry approval. All submitted photos and videos are reviewed by our team before going live. We reserve the right, at our sole discretion, to decline or remove any entry that we consider inappropriate, offensive, misleading, of insufficient quality, or in breach of these Terms. Declined entries are not eligible for refund, as entry is free.
5.4 Entry closing. Entries for each monthly competition close three days before the end of that calendar month. Entries submitted during this window will be placed into the following month’s competition.
5.5 Your child’s profile. Once approved, your child’s entry will be displayed on a public competition profile showing their first name, their entry photo or video (watermarked), their vote count, and their leaderboard ranking. No surname, address, or personal contact details will ever be displayed publicly.
5.6 Watermarking. All photos and videos submitted to the platform are automatically watermarked with the Cutie Clash Pageant watermark before publication. This is a mandatory condition of entry and cannot be opted out of.
5.7 Entry content. By submitting a photo or video, you confirm that:
- You are the photographer or videographer, or have the full rights to use the content submitted;
- The content depicts only the child being entered, or that you have the consent of all other individuals depicted;
- The content does not infringe any third-party intellectual property rights;
- The content is appropriate for a family audience and does not contain nudity, violence, offensive language, or other objectionable material;
- You grant Cutie Clash Pageant (Pty) Ltd a non-exclusive, royalty-free, worldwide licence to display, reproduce, and share the submitted content on the Website and official Cutie Clash Pageant social media channels for the purpose of operating and promoting the competition.
6. Voting
6.1 Free daily votes. Registered users receive five (5) free votes per day, credited automatically to their account at midnight each day. Free daily votes reset every 24 hours and may not be accumulated or carried over. Free daily votes may be cast for any entry on the platform.
6.2 Games votes. Registered users may earn additional bonus votes by playing games available on the Games page of the Website. Bonus votes are awarded upon successful completion of eligible games as specified on the Games page at the time of play. Game vote values and daily play limits are subject to change at any time without notice. Games must be played manually — the use of any automated tools, bots, scripts, or software to play games or earn votes is strictly prohibited.
6.3 Spin the Wheel. Registered users may spin the Cutie Clash Pageant vote wheel once per week for a chance to receive bonus votes. The number of votes awarded depends on the outcome of the spin. Spin results are final, non-transferable, and non-reversible.
6.4 Purchased votes. Additional votes may be purchased via the payment methods listed on the Buy Votes page of the Website. Current pricing for vote bundles is displayed on that page and may be updated from time to time.
6.5 Double Madness Wednesdays. On every Wednesday during a competition month, votes purchased via paid methods will be automatically doubled. This mechanic applies to purchased votes only and does not apply to free daily votes, games votes, or spin the wheel votes. The doubling mechanic resets at 23:59:59 each Wednesday.
6.6 Voting period. Voting opens at 00:00 on the first day of each competition month and closes at 23:59:59 on the last day of that competition month. Votes received outside these times will not be counted.
6.7 Voting integrity. We actively monitor voting activity for patterns that suggest fraud, manipulation, or breach of these Terms. Any of the following may result in disqualification of the relevant entry and/or termination of the relevant account, without refund:
- The use of multiple accounts to accumulate votes;
- Coordinated artificial vote inflation through third parties;
- Automated or bot-assisted voting or game play;
- Any other activity designed to gain an unfair voting advantage.
7. Payment for Purchased Votes
7.1 Vote purchases are processed through our secure third-party payment provider. We do not store payment card information on our servers.
7.2 All prices are displayed in South African Rand (ZAR) and are inclusive of applicable VAT where required.
7.3 By completing a vote purchase, you authorise the relevant charge to your selected payment method. You confirm that you are the authorised account holder or have the bill payer’s permission for the payment method used.
7.4 Vote purchases are fulfilled immediately upon successful payment confirmation. Purchased votes are credited to your account within a reasonable time following payment confirmation.
7.5 In the event of a payment failure or technical error during a vote purchase, please contact us at hello@cutieclashpageant.co.za with proof of payment. We will investigate and resolve confirmed errors as quickly as possible.
8. Refund Policy
8.1 Completed vote purchases are non-refundable, except in the following circumstances:
- A confirmed technical error on the part of Cutie Clash Pageant (Pty) Ltd resulted in votes not being credited to your account following a successful payment; or
- A duplicate charge occurred due to a confirmed technical fault.
8.2 Refund requests must be submitted to hello@cutieclashpageant.co.za within 14 days of the relevant transaction, with proof of payment included.
8.3 Refunds will be processed to the original payment method within 10 business days of a refund being approved.
8.4 The cancellation of a competition, or a child’s entry being disqualified due to a breach of these Terms, does not entitle you to a refund of purchased votes.
9. Prizes
9.1 At the close of each competition month, the Top 3 entries by total vote count are declared that month’s competition winners. In addition, one entry is selected at random from all valid entries for that month and declared the Random Draw Winner, regardless of their vote count or leaderboard position.
9.2 The current month’s prize structure is detailed on the Prizes page of the Website. Prizes rotate monthly and may include cash, hampers, kids’ vouchers, or other items at the Company’s discretion.
9.3 Prizes are non-transferable, non-exchangeable, and may not be redeemed for cash except where the prize itself is cash.
9.4 The Company reserves the right to substitute any prize with an alternative of equal or greater value should the advertised prize become unavailable for any reason.
9.5 Winners will be announced on the Winners Hall of Fame page and via the Company’s official social media channels. Prize winners will be contacted directly within five (5) business days of the competition closing using the contact details provided at the time of entry.
9.6 Prize winners are required to verify their identity, age, and South African residency, and to provide a valid South African bank account before any cash prize is released. The Company reserves the right to request such verification documentation as it deems necessary.
9.7 Cash prizes will be paid into South African bank accounts only, within 10 to 15 business days of successful verification.
9.8 Failure to respond to prize winner notifications within seven (7) days of being contacted may result in the prize being forfeited. The Company is not responsible for notifications that are undelivered due to incorrect contact details provided by the winner.
9.9 The Company’s decision on all prize-related matters is final and binding.
10. Intellectual Property
10.1 All content on the Website — including but not limited to the Cutie Clash Pageant name, logo, design, text, graphics, software, and functionality — is owned by or licensed to Cutie Clash Pageant (Pty) Ltd and is protected by South African and international intellectual property laws.
10.2 You may not copy, reproduce, distribute, modify, publish, or create derivative works of any Website content without our prior written consent.
10.3 As set out in clause 5.7, by submitting a photo or video, you grant the Company a non-exclusive licence to use that content for competition and promotional purposes. You retain ownership of your content. This licence continues for as long as your entry remains on the platform and for a reasonable period thereafter for archival or promotional purposes. You may request removal of your content by contacting us at hello@cutieclashpageant.co.za.
11. Privacy & Protection of Personal Information
11.1 Cutie Clash Pageant (Pty) Ltd is the Responsible Party, as defined under the Protection of Personal Information Act 4 of 2013 (POPIA), for all personal information collected through the Website and competition.
11.2 We collect and process personal information only for the purposes of operating the competition, administering user accounts, processing payments, communicating with users, and awarding prizes. We do not sell personal information to third parties.
11.3 Your child’s personal information — including their full name, date of birth, and any information not provided voluntarily for public display — will never be made publicly available on the Website.
11.4 Our full Privacy Policy, which sets out in detail what information we collect, how we use it, how long we retain it, and your rights as a data subject, is available at cutieclashpageant.co.za/privacy-policy and forms part of these Terms.
11.5 You have the right to access, correct, or request deletion of your personal information held by us. To exercise these rights, contact us at hello@cutieclashpageant.co.za.
12. Prohibited Conduct
You agree not to use the Website or the competition in any way that:
- Violates any applicable South African law or regulation;
- Infringes the rights of any third party, including intellectual property rights or privacy rights;
- Involves the submission of false, misleading, or fraudulent information;
- Involves creating multiple accounts to gain an unfair competitive advantage;
- Involves the use of automated tools, bots, or scripts to vote, play games, or interact with the platform;
- Involves harassing, threatening, or abusing other users, entrants, or Company staff;
- Involves attempting to interfere with, disrupt, or compromise the security or integrity of the Website or competition;
- Involves uploading content that is offensive, defamatory, pornographic, or harmful to minors;
- Is designed to manipulate competition outcomes through any dishonest means.
The Company reserves the right to take any action it deems appropriate in response to prohibited conduct, including account suspension, disqualification, and where required by law, reporting the matter to the relevant authorities.
13. Disclaimers & Limitation of Liability
13.1 The Website and competition are provided on an “as is” and “as available” basis. While we make every reasonable effort to keep the platform running smoothly and accurately, we do not warrant that the Website will be error-free, uninterrupted, or free from viruses or other harmful components.
13.2 The Company will not be liable for any loss or damage arising from:
- Temporary unavailability or interruption of the Website;
- Loss of votes, data, or competition position due to technical faults beyond our reasonable control;
- Unauthorised access to your account as a result of your failure to maintain the security of your login credentials;
- Any indirect, special, incidental, or consequential loss or damage of any kind.
13.3 Nothing in these Terms limits or excludes any liability that cannot be excluded under applicable South African law, including the Consumer Protection Act 68 of 2008.
13.4 Our total liability to you for any claim arising from or relating to your use of the Website or participation in the competition shall not exceed the total amount you have paid to the Company in the 30 days preceding the event giving rise to the claim.
14. Third-Party Links & Services
The Website may contain links to third-party websites or integrate with third-party payment providers and services. These third-party services are governed by their own terms and privacy policies. The Company is not responsible for the content, accuracy, or practices of any third-party website or service, and the inclusion of any link does not imply our endorsement of that third party.
15. WASPA Compliance
Where voting via mobile or SMS-based services is offered, the Company adheres to the Code of Conduct of the Wireless Application Service Providers’ Association (WASPA). Standard network rates apply to all data usage. Free SMSes and bundled SMSes may not be used for SMS-based voting where applicable.

17. Changes to These Terms
We reserve the right to update or amend these Terms at any time. The current version, along with the date of the most recent update, will always be available on this page. Where changes are material, we will make reasonable efforts to notify registered users via email. Your continued use of the Website after any update constitutes your acceptance of the revised Terms.
18. Governing Law & Jurisdiction
These Terms and Conditions, and any dispute arising from or relating to them, are governed exclusively by the laws of the Republic of South Africa. You agree to submit to the non-exclusive jurisdiction of the South African courts in respect of any such dispute.
19. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.
20. Entire Agreement
These Terms, together with the Competition Rules and Privacy Policy, constitute the entire agreement between you and Cutie Clash Pageant (Pty) Ltd in relation to your use of the Website and participation in the competition. They supersede all prior agreements, representations, and understandings.
